License Terms

The agreement governing content licensed on Fast Media. The scope you select at checkout — recorded on your licence certificate — determines which usage sections apply.

Draft — under review. Territory, duration and liability defaults below are proposed and being confirmed against supplier agreements and legal advice.

1. The licence

Each purchase grants a non-exclusive, non-transferable, non-sublicensable licence for one image, for the usage scope selected at checkout. Unless stated otherwise on the certificate or for the collection, the licence is worldwide for the licensed use.

The licence is held by your organisation and may be exercised by every user on your account, within your organisation's own projects and the client work described in section 7. It is documented by the licence record in your account and the downloadable licence certificate. Copyright in the content remains with Fast Media's suppliers and their contributors; this licence grants usage rights only and transfers no ownership.

Some collections carry territorial or usage restrictions; where they apply, they are shown before purchase and noted on the certificate.

2. Duration & renewal

Unless the certificate or your quote records otherwise, licences run as follows from the date of purchase:

  • Editorial licences — one (1) year; Books — three (3) years
  • Commercial licences — perpetual
  • Creative stock (standard and extended) — perpetual

Within the licensed scope and term, reproduction is unlimited — there are no print-run, copy or impression caps. To continue an editorial use beyond its term, renew the licence before it expires: team@fastmediahouse.com.

3. Editorial licences

Editorial licences cover use in news and informational contexts, without implied endorsement by people depicted. The available editorial scopes are:

  • Editorial online — websites, apps and social channels of an editorial publication
  • News — newspaper and news-service publication
  • Magazine — periodical print and digital editions
  • Books — book publishing, print and digital
  • Broadcast — television and streaming editorial productions

Editorial content may not be used commercially — not in advertising, marketing or merchandise. Take particular care with sensitive contexts: do not use editorial imagery to imply negative traits, health status, beliefs or endorsements of identifiable people. Where a credit line is stated, attribution is required.

4. Commercial licences

Commercial licences cover advertising and marketing use in the scope selected:

  • Commercial print — printed advertising and marketing material
  • Commercial online — digital advertising, websites and social media marketing
  • Commercial TV — television and streaming advertising

Commercial use of imagery featuring identifiable people, private property or trademarks requires the appropriate releases (see section 8). Where a collection is marked editorial-only, no commercial licence is available for it; the platform warns you before purchase when commercial clearance is in question.

5. Creative stock

Creative stock is licensed at full resolution under a standard licence covering general commercial and editorial use within your organisation's projects — websites, social media, presentations, marketing material and similar. Uses beyond the standard licence require the extended licence (see section 6).

6. Extended licence

The extended licence adds rights the standard scopes exclude — in particular use in products for resale (merchandise, templates, print-on-demand) — for an additional fee shown at checkout. Extended rights apply only where the certificate records them.

7. Client work & subcontractors

You may use licensed content to produce end work for your clients — campaigns, publications, designs and similar deliverables — provided the licence and the standalone file remain with your organisation. If a client needs to hold the licence itself, or to reuse the standalone content beyond the work you delivered, the client requires its own licence from Fast Media.

Your subcontractors may temporarily handle licensed files in a production or distribution process carried out strictly on your behalf, provided they observe these terms. They acquire no rights of their own, and you remain responsible for their compliance.

8. Releases & clearances

Unless expressly stated for a collection or item, no model or property releases are obtained or warranted for licensed content. Fast Media grants no rights in — and makes no warranty regarding — names, likenesses, trademarks, logos, designs, works of art or architecture depicted in the content.

You are solely responsible for determining whether your intended use requires additional releases or clearances — in particular for commercial use of identifiable people, private property or trademarks — and for obtaining them. When in doubt, seek advice before publishing.

9. All licences — not permitted

  • reselling, redistributing, sublicensing or republishing the file itself;
  • making licensed content available for download on a shared drive, service, website or in any other electronic form;
  • using licensed content in a logo, trademark or trade dress;
  • minting licensed content as NFTs;
  • using licensed content to train machine-learning or AI models;
  • removing, altering or obscuring copyright information or credits;
  • using preview/comp files in published material — previews are for mockups only;
  • unlawful, defamatory or pornographic use, or use that violates the rights of people depicted.

10. Warranties

Fast Media warrants that it has the authority to license the content as delivered. Beyond that, content is provided "as is": no warranty is made that content is suitable for your specific purpose, that it is accompanied by releases (section 8), or that your particular use will not infringe the rights of a third party. These warranties are void where content is altered beyond the licensed use or used in breach of this agreement.

11. Indemnities & liability cap

You agree to indemnify Fast Media B.V., its officers, employees and suppliers against claims, damages and reasonable costs arising from your use of licensed content in breach of this agreement or outside the licensed scope.

Provided you have not breached this agreement, Fast Media will indemnify you against third-party claims arising directly from Fast Media's breach of the warranty in section 10, on condition that you notify us promptly in writing (team@fastmediahouse.com), give us full cooperation, and allow us control of the defence or settlement.

Fast Media's maximum aggregate liability per item of content — under this indemnity or otherwise — is limited to the licence fee paid for that content. Neither party is liable for indirect or consequential damages.

12. Termination & unauthorised use

This licence ends automatically if you materially breach this agreement. On termination you must cease all use of the affected content, delete the files in your possession, and remove the content from material not yet published. Use of content in any manner not authorised by this agreement voids the warranties and indemnities in sections 10 and 11 for that content.

13. Governing law

This agreement is governed by Dutch law. Disputes that cannot be resolved amicably are submitted to the competent court in Amsterdam, the Netherlands. This page forms part of the Fast Media Terms of Service, which incorporate it by reference.

14. Certificates & questions

Every licence comes with a certificate recording the image, licensee, scope, and date — your proof of licence. If you are unsure whether your intended use is covered, ask before publishing: team@fastmediahouse.com. We will advise on the right scope or arrange custom terms.
